The Supreme Court’s recent ruling sharply limiting the use of nationwide injunctions is a serious setback for undocumented immigrants and their families. By restricting lower federal courts from issuing broad orders that block federal immigration policies across the entire country, the Court has cleared the way for the Trump administration to move forward with its executive order targeting birthright citizenship. This means that, unless you are a plaintiff in one of the ongoing lawsuits, the protections that previously shielded all undocumented immigrants from harmful new policies may no longer apply to everyone equally. As a result of this thousands of U.S.-born children whose parents are undocumented now face the risk of being denied their constitutional right to citizenship, depending on where they live or whether they are part of a specific legal challenge. The order moves forward.
